On February 26, 2009 the Court of Appeal held that consideration of the Office of Fair Trading (OFT) the power, if charges for unauthorized transactions, unjust and excessive, if to be assessed under the Unfair in Consumer Contracts Regulations (UTCCR) confirmed the earlier decision of this High Court paves the way for the OFT’s investigation of whether bank charges are unfair and unreasonable to conclude.
In addition to the unanimous decision of three judges of the Court of Appeals for the OFT, master of the Rolls Sir Anthony Clarke, refused to leave the banks to oppose the decision of the House of Lords to appeal. Although banks have the right to hear a complaint directly to the request of the House of Lords that the fact that the third most senior judge in England and Wales has refused to say at this stage the complaint that the judge considers that the problems must be solved by the OFT.
The fact that the Court of Appeal a unanimous decision, in which they leave, refused to call is a great success for the OFT and consumers. We hope that banks now accept that they have little chance of winning in this legal process, and begin working with the OFT to ensure a rapid solution to this case to bring to the consumer for repayment of expenses incurred, which they are safe.
If banks can go to ask to go directly to the Law Lords, these are significant costs to the taxpayer funds the OFT, and many banks. We should believe that after such a clear verdict, the banks now allow the OFT to decide whether the costs of determining the fair, although we news on banks to see if the appeal.
The OFT said it “very clear confirmation of the decision of the appeal today welcomes the terms are disordered overdraft fees for personal accounts to assess the fairness.” The OFT must close now, and publish a report, in the fairness of the tax that has worked on since April 2007. The OFT has already written to the banks with its preliminary views on the fairness of the conditions under which the concerns they might be a bit unfair. We believe, therefore, unlikely that, despite the decision of the Court of Appeal, consumers that the refund of fees are received by the end of 2009.
